The following privacy policy applies to the use of our online offering at www.medvital-residenz.de ( hereafter ‘website’).
We attach great importance to data protection. The collection and processing of your personal data is carried out in compliance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR). We only process our users’ personal data to the extent necessary to provide a functional website and our content and services. The processing of our users’ personal data only takes place regularly with the user’s consent. An exception applies in cases where prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law.

A. General
I. Definitions
1. personal data
‘Personal data’ means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

‘Processing’ means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
II. Legal basis for the processing of personal data
Insofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.
When processing personal data that is necessary for the fulfilment of a contract to which the data subject is a party, Art. 6 para. 1 lit. b) GDPR serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures.
Insofar as the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c) GDPR serves as the legal basis.
In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d) GDPR serves as the legal basis.
If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f) GDPR serves as the legal basis for the processing.
III. Data erasure and storage duration
The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Data may also be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or erased if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.
B. What data we use and why
I. Hosting
The hosting services we use serve to provide the following services: Infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services that we use for the purpose of operating the website.
In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors to this website on the basis of our legitimate interests in the efficient and secure provision of our website in accordance with Art. 6 para. 1 sentence 1 f) GDPR in conjunction with Art. 28 GDPR. II. Access data
We collect information about you when you use this website. We automatically collect information about your usage behaviour and your interaction with us and register data about your computer or mobile device. We collect, store and use data about every access to our website (so-called server log files). The access data includes:
- Name and URL of the retrieved file
- Date and time of retrieval
- Amount of data transferred
- Notification of successful retrieval (HTTP response code)
- Browser type and browser version
- Operating system
Referrer URL (i.e. the previously visited page) - Websites that are accessed by the user’s system via our website

We use this log data without attribution to your person or other profiling for statistical evaluations for the purpose of the operation, security and optimisation of our website, but also to anonymously record the number of visitors to our website (traffic) and the extent and type of use of our website and services, as well as for billing purposes to measure the number of clicks received from cooperation partners. Based on this information, we can provide personalised and location-based content and analyse data traffic, search for and rectify errors and improve our services. This is also our legitimate interest in accordance with Art. 6 para. 1 sentence 1 f) GDPR.
We reserve the right to check the log data retrospectively if there is a justified suspicion of unlawful use based on concrete evidence. We store IP addresses in the log files for a limited period of time if this is necessary for security purposes or for the provision or billing of a service, e.g. if you use one of our offers. After cancelling the order process or after receipt of payment, we delete the IP address if it is no longer required for security purposes. We also store IP addresses if we have a concrete suspicion of a criminal offence in connection with the use of our website. We also store the date of your last visit as part of your account (e.g. when registering, logging in, clicking on links, etc.).
III. Cookies
We use so-called session cookies to optimise our website. A session cookie is a small text file that is sent by the respective servers when you visit a website and is temporarily stored on your hard drive. This file as such contains a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognised when you return to our website. These cookies are deleted after you close your browser.
We also use a small number of persistent cookies (also small text files that are stored on your end device), which remain on your end device and enable us to recognise your browser the next time you visit. These cookies are stored on your hard drive and delete themselves after the specified time. Their lifespan is 1 month to 10 years. When the cookie is activated, it is assigned an identification number and your personal data is not assigned to this identification number. Your name, IP address or similar data that would allow the cookie to be assigned to you are not stored in the cookie. Based on the cookie technology, we only receive pseudonymised information, for example about which pages have been visited, etc. You can set your browser so that you are informed in advance about the setting of cookies and can decide in individual cases whether you want to exclude the acceptance of cookies for certain cases or in general, or that cookies are completely prevented. This may limit the functionality of the website.
IV. Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

This data is not merged with other data sources.
The basis for data processing is Art. 6 para. 1 lit. f GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.
V. Data for the fulfilment of our contractual obligations
We process personal data that we require to fulfil our contractual obligations, such as name, address and email address. The collection of this data is necessary for the conclusion of the contract. The data is deleted after the warranty periods and statutory retention periods have expired.
The legal basis for the processing of this data is Art. 6 para. 1 sentence 1 b) GDPR, because this data is required so that we can fulfil our contractual obligations towards you.
VI. Contact form; e-mail contact
When you contact us (e.g. via contact form or e-mail), we process your data to process the enquiry and in the event that follow-up questions arise. If the data processing is carried out in order to take steps at your request prior to entering into a contract or, if you are already our customer, in order to fulfil the contract, the legal basis for this data processing is Art. 6 (1) sentence 1 b) GDPR. We only process other personal data if you consent to this (Art. 6 para. 1 sentence 1 a) GDPR) or if we have a legitimate interest in processing your data (Art. 6 para. 1 sentence 1 f) GDPR). C. Google Analytics
We use Google Analytics, a web analysis service of Google Inc. (‘Google’), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google Analytics uses ‘cookies’, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about the use of this website by site visitors is usually transferred to a Google server in the USA and stored there. This is also our legitimate interest in accordance with Art. 6 para. 1 sentence 1 f) GDPR.
Google has submitted to the Privacy Shield agreement concluded between the European Union and the USA and is certified. We have activated IP anonymisation on this website (anonymizeIp). However, this means that your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use this information on our behalf to analyse your use of the website, to compile reports on website activity and to provide us with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. This website uses the ‘demographic characteristics’ function of Google Analytics. This allows reports to be created that contain statements about the age, gender and interests of site visitors. This data comes from interest-based advertising from Google and visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the section ‘Objection to data collection’.
D. Google AdWords / Google Conversion Tracing
This website uses Google AdWords. AdWords is an online advertising programme of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (‘Google’).
As part of Google AdWords, we use what is known as conversion tracking. When you click on an advert placed by Google, a cookie is set for conversion tracking. Cookies are small text files that the Internet browser stores on the user’s computer. These cookies lose their validity after 30 days and are not used to personally identify the user. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognise that the user clicked on the ad and was redirected to this page.
Each Google AdWords customer receives a different cookie. The cookies cannot be tracked via the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers are told the total number of users who clicked on their advert and were redirected to a page with a conversion tracking tag. E. Google Maps
This site uses the Google Maps map service via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. F. OpenStreetMap
We use the open source map service ‘OpenStreetMaps’ (= ‘OSM’) to display geodata. The provider is the company OpenStreetMap Foundation CLG, 132 Maney Hill Road, Sutton Coldfield, West Midlands, B72 1JU, United Kingdom. OSM is used to provide an interactive map on our website that shows you where BLE projects are located, for example. To use OSM, it is necessary to save the IP address of your device and the map material is loaded from an external server.
The use of OSM is in the interest of an appealing presentation of our online offers and to make it easy to find the places we have indicated on the website; this constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR (legitimate interest in data processing).

G. Instagram
I. Website
Our website uses social plugins (‘plugins’) from Instagram, which is operated by Meta Platforms Ireland Ltd, 4 Grand Canal Square, Dublin 2, Ireland (‘Instagram’). The plugins are labelled with an Instagram logo, for example in the form of an ‘Instagram camera’.
When you access a page on our website that contains such a plugin, your browser establishes a direct connection to Instagram’s servers. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. Through this integration, Instagram receives the information that your browser has accessed the corresponding page of our website, even if you do not have an Instagram profile or are not currently logged in to Instagram. Instagram fulfils all obligations under the GDPR with regard to the processing of Insights data. The controllers do not make any decisions regarding the processing of Insights data and all other information resulting from Art. 13 GDPR. These are only provided by Instagram Insights.

The data controllers process the following personal data of users when they interact with the Instagram page: public profile information of the user; personal data provided in comments; personal data provided in replies to posts; personal data provided when people are tagged in photos; further statistical data of Instagram users is processed via Instagram Insights (analysis services for use and interaction with Instagram pages). Instagram does not provide the data controllers with any personal data. Those responsible only receive numerical analyses from Instagram on the use and interaction of users with the Instagram page.
The legal basis for the processing of personal data is Art. 6 para. 1 lit. f GDPR (protection of legitimate interests). The controllers also process users’ personal data to protect their legitimate interests. These are the following purposes: evaluation of the analyses and statistics of the Instagram page created and provided by Instagram with regard to interaction by users with the Instagram page; communication and interaction via the Instagram page; development of the number of subscribers to the Instagram page. The controllers do not have access to the personal data processed by Instagram as part of Insights.
H. Facebook
I. Facebook Like-Button
This website uses social media plugins (“plugins”) from the social network facebook.com, which is operated by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland (“Facebook”). This site uses the option to activate the plug-ins used before they process user data. The “2-click buttons” used for this purpose must be activated separately. If these buttons are not activated, the provider will not transfer any data to Facebook.
When a user visits a website of this provider that contains such a plugin, their browser establishes a direct connection to the Facebook servers. The content of the plugin is transmitted directly from Facebook to your browser, which then integrates it into the website. II. Meta Pixel
Our website uses the visitor action pixel from Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland (“Facebook”) to measure conversions.
This allows the behavior of site visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook ad. This allows the effectiveness of Facebook ads to be evaluated for statistical and market research purposes and to optimize future advertising measures.
The data collected is anonymous to us as the operator of this website; we cannot draw any conclusions about the identity of the users. I. YouTube
Our website uses plug-ins from the YouTube site operated by Google. The site is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages equipped with a YouTube plug-in, a connection is established to the YouTube servers. The YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account. YouTube is used in the interest of an appealing presentation of our online offerings. This represents a legitimate interest within the meaning of Art. 6 (1) (f) GDPR.

J. Storage period
Unless specifically stated, we only store personal data for as long as necessary to fulfill the purposes pursued. In some cases, the law requires the retention of personal data, for example, in tax or commercial law. In these cases, we will only continue to store the data for these legal purposes, but will not process it for any other purpose, and will delete it after the statutory retention period has expired.

You also have the right to object to the lawful processing of your personal data by us if this is based on your particular situation and our interests in the processing do not override yours. In detail:
You have the right to object at any time to the processing of personal data concerning you based on Art. 6 (1) (e) or (f) GDPR, for reasons related to your particular situation; this also applies to profiling based on these provisions. We will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims.
If we process personal data for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for the purposes of such advertising; this also applies to profiling insofar as it is related to such direct marketing.
You have the right to object, for reasons related to your particular situation, to the processing of personal data concerning you for scientific or historical research purposes or for statistical purposes pursuant to Art. 89 (1) GDPR, unless the processing is necessary to perform a task carried out in the public interest.
II. Further rights of data subjects
If you have given your consent, you have the right to revoke it in accordance with Art. 7 (3) GDPR. Please note that revocation does not change the legality of the processing carried out up to the time of revocation (revocation has no retroactive effect).
You have the right, within the scope of the GDPR, to receive information about the personal data concerning you that we hold free of charge upon request (Art. 15 GDPR).
Furthermore, in accordance with the GDPR, you have the right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction (Art. 18 GDPR), and transfer (Art. 20 GDPR) of your personal data.
You also have the right to lodge a complaint with the data protection supervisory authority responsible for us in justified cases (Art. 77 GDPR). The competent supervisory authority for data protection issues is the State Data Protection Commissioner of the federal state in which our company is headquartered. L. Data securitiy
We make every effort to ensure the security of your data within the framework of applicable data protection laws and technical possibilities. Your personal data is transmitted using encrypted means. This applies to your orders and also to the customer login. We use the SSL (Secure Socket Layer) or TLS (Transport Layer Security) coding system. You can recognize an encrypted connection by the browser’s address line changing from “http://” to “https://” and by the lock symbol in your browser bar. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties. However, we would like to point out that data transmission over the Internet (e.g., when communicating by email) can have security gaps. Complete protection of data from access by third parties is not possible.
To protect your data, we maintain technical and organizational security measures in accordance with Art. 32 GDPR, which we continually adapt to the state of the art. We also do not guarantee that our service will be available at specific times; Disruptions, interruptions, or failures cannot be ruled out. The servers we use are regularly and carefully backed up.
M. Transfer of data to third parties, no data transfer to non-EU countries
As a general rule, we only use your personal data within our organization. If and to the extent that we engage third parties to fulfill contracts (such as logistics service providers), they will only receive personal data to the extent that the transmission is necessary for the corresponding service. In the event that we outsource certain parts of data processing (“contract processing”), we contractually oblige the processors to use personal data only in accordance with the requirements of data protection laws and to ensure the protection of the rights of the data subject. Data transfer to locations or persons outside the EU outside of the case stated in Section 4 of this declaration does not take place and is not planned.
